Terms and Conditions

1. Who We Are

Thuso ("the Platform," "we," "us," "our") is an online service that allows business owners to register their businesses, list services, and connect with customers seeking to book those services.

The Platform is currently operated by its founders and creators (the "Operators") as an unincorporated venture. The Operators are the data controller for the purposes of the Botswana Data Protection Act, 2024, and are personally accountable for compliance with these Terms and applicable law until such time as the Platform is operated by a duly incorporated legal entity, at which point these Terms will be updated to reflect that entity as the contracting party.

2. Acceptance of These Terms

By creating an account, registering a business, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform. You must be at least 18 years old, or the age of majority in your jurisdiction, to register a business or account.

3. The Beta Program

The Platform is currently in a limited beta testing phase. By participating, you acknowledge that: features and data structures may change without notice; we may collect feedback via surveys or usage analytics for the purpose of improving the Platform, participation in which is voluntary; service availability is not guaranteed during beta and we are not liable for data loss, downtime, or errors arising from beta status, except as required by law; beta participation may be ended by either party at any time with reasonable notice where practicable.

4. Accounts and Registration

You must register using a valid phone number or email address and complete our verification process. You are responsible for the confidentiality of any credentials or codes associated with your account and for all activity under it. You agree to provide accurate, current, and complete information and to keep it up to date. A business may have more than one owner; each owner is independently responsible for their own actions, and we are not responsible for disputes between co-owners.

5. Business Listings and Services

Business owners are solely responsible for the accuracy of information they list. We do not verify legal existence, licensing, or good standing of any business unless expressly stated. Prices, currencies, and service details are set by the business owner; we are not a party to any transaction between a business and its customers and do not process payments at this time. We may remove or suspend any listing we reasonably believe violates these Terms or is unlawful.

6. Deletion and Account Actions

Deleting a business or service requires additional confirmation — a one-time verification code sent to the acting owner's own registered contact method, plus typed confirmation of the item's name — before it takes effect. This is a deliberate safeguard against unauthorized or unilateral deletion by a co-owner or third party. You are responsible for keeping your registered contact method current.

7. Acceptable Use

You agree not to: use the Platform unlawfully or in violation of Botswana's Data Protection Act, 2024 or consumer protection law; impersonate any person or business; attempt unauthorized access to another user's account or data; scrape or bulk-extract data without consent; send unsolicited communications via the Platform; upload content you don't have rights to or that is unlawful or infringing.

8. Intellectual Property

The Platform's design, software, and branding belong to the Operators. Business owners retain ownership of content they upload but grant us a limited license to host, display, and process it to operate the Platform.

9. Disclaimers

The Platform is provided "as is," particularly during beta. We disclaim warranties to the fullest extent permitted by law, and are not responsible for the conduct of businesses or customers, service quality, or communications (including WhatsApp reminders/confirmations) sent by business owners to customers.

10. Limitation of Liability

To the extent permitted by law, the Operators are not liable for indirect, incidental, or consequential damages. Nothing here limits liability that cannot be excluded under Botswana law, including the Data Protection Act, 2024.

11. Termination

We may suspend or terminate access for breach of these Terms or unlawful conduct. You may stop using the Platform and request account deletion at any time via thusosystems@gmail.com.

12. Changes to These Terms

We may update these Terms, particularly as the Platform exits beta or incorporates. We'll make reasonable efforts to notify active users of material changes.

13. Governing Law

Governed by the laws of Botswana; disputes subject to the jurisdiction of Botswana's courts.
